MINUTES OF THE PUBLIC MEETING OF JULY 27TH, 2004
HANSON TOWN HALL, LIBERTY ST., HANSON, MA

Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in the Conservation Office on the second floor of Town Hall.

Voting on the minutes of June 22nd, 2004 will be postponed until August 10, 2004.

Public Hearings
7:45 PM  Notice of Intent for the installation of a new subsurface sewage disposal system, new private water supply well, and site grading at 11 Fallon Point Road, Assessor's Map 69, Lot 7 for applicant Donald Sampson, 181 Mattakeesett St., Pembroke represented by Land Planning, Inc., 1115 Main St., Hanson, MA.  (New Hearing)  (DEP #175-436)

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Mr. Munro of Land Planning, Inc. presented a septic upgrade plan to bring the system into compliance.  The old cesspool is to be pumped and filled.  The new septic is out of the 50-foot no disturb zone.  Ms. Delaney said the plan is accurate and recommends approval.  However, a shed  to be raised is actually outside the proposed haybale line.  She suggests the haybales go around it.

8:00 PM  Request for Determination of Applicability for the expansion of a deck at 117 State Street, Assessor's Map 96, Lot 0012-02  for owners Thomas & Jane Finn represented by Jeremy Barstow, 19 Elko St., Apt.4,  Brighton, MA.  (New Hearing )

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Mr. Barstow presented a plan for extending a deck deemed unsafe about 8’ feet in either direction.  Ms. Delaney
inspected and suggests approval as it clearly meets setback requirements.

8:15 PM  Notice of Intent for the proposal of an addition and parking with associated grading at 2 Main Street, Assessor’s Map 38, Lot 5 for V.S.H. Realty/Cumberland Farms, 777 Dedham St., Canton, MA  02021 represented by Land Planning, Inc., 1115 Main St., Hanson, MA  (New Hearing)  (DEP #175-438)

Craig Nicholson read the Public Hearing Notice and the green cards were checked. Mr. Munro of Land Planning presented a proposal to block in the store with an addition and put in additional parking.   In 1997, a fuel leak from the tanks in front was discovered and subsequently cleaned up and new tanks installed.   There is a question as to who made the certification.  Mr. Lindquist has concerns with storm water runoff as only one catch basin is shown on the plan.  Ms. Delaney made an inspection and also has concerns with discharge from adding additional parking spaces.  Mr. Munro said that there are no new parking spaces proposed, the area is only being squared off.   However, more research is needed and a Zoning hearing is scheduled for Aug. 17th.

8:30 PM Continued Notice of Intent for construction of a single family house and associated site work within the 100-foot buffer zone at 108 Pleasant St. (Rear) Map 32, Lot 37-1 with Richard & Melly Eaton represented by Grady Consulting, Inc., 39 Pond View Drive, Kingston, MA  02364.  (DEP #175-437)  

This hearing was continued from July 13, 2004 (See minutes).  Grady Consulting submitted a letter saying they would not be attending this hearing.  Ms. Delaney had made an inspection and it was her opinion that the wetland line was delineated very conservatively and she suggests approving the Notice of Intent.

This hearing had been continued from July 13, 2004 (See minutes).  The Board of Commissioners was waiting for an up-dated plan showing the new location of one wetland flag.  This plan was received and reviewed by Ms. Delaney and the Board and was approved.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Mr. D’Emilia
purchased this property and has a permit for a septic upgrade.  Mr. D’Emilia would like to put an addition on the building and is presently waiting for approval from the Zoning Board of Appeals.  He would like to know if the Conservation Commission is amenable to his plans before he goes any further with an Engineer.  The Board was certainly open to any improvement in that area.  However, Ms. Delaney thinks that this might be in the riverfront area in which case Mr. D’Emilia would have to file additional paperwork with the State and the Conservation office.

Craig Nicholson read the Public Hearing Notice and the green cards were checked.  Alan Dias presented a proposal for a septic upgrade as the existing cesspool had failed.  Ms. Delaney had inspected the property and her assessment was that the wetland line was accurate.  However, she had observed debris in the wetlands, cinderblocks and tires, etc. that should be cleaned out by hand.  Mr. Dias had no problem with that.  Mr. Lindquist read off the abutter’s list.  None were present.
